Terms of Use

These terms apply to all relationships between users and the native app and LINE app (hereinafter referred to as “this site”) of Oita Daiichi Hoverdrive Co., Ltd. (hereinafter referred to as “the operating company”) when using this site, as well as the company from which the boarding ticket was purchased.

Definitions

  1. “This service” refers to the hovercraft digital ticket (Hoverdrive app) organized and operated by this site for the purpose of hovercraft reservations using the internet.
  2. “User” refers to those who have registered as members of the Hoverdrive app after agreeing to these terms, or those who have registered the Hoverdrive app as a friend on LINE.

Scope of Terms of Use

Article 1

These terms apply to users of this service. Users are deemed to have agreed to these terms when they register as members of the Hoverdrive app or register the Hoverdrive app as a friend on LINE and use it.

Article 2

Matters related to the handling of hovercraft boarding tickets purchased using this service, other operational matters, and other matters related to the operation will be handled in accordance with the terms and conditions set by the operating company. Therefore, issues related to fare collection, etc., will be handled by the company that collected the fare from the user, not this site.

Scope of Service

Article 3

  1. Users can use the following services. However, to use these services, it is necessary to add and register or enter credit card number information.
    (1)Purchase, reservation, use, and transfer of digital tickets
    (2)Payment by credit card
    (3)Confirmation, change, cancellation, and refund of reservation details
  2. This service is implemented for routes and flights permitted by the operating company.
  3. This service can be used on devices such as PCs, smartphones, and tablets. However, it may not be available depending on the device or model.
  4. This site may add or delete the service menu specified in the preceding paragraphs by notifying as specified in Article 4.
  5. This service is provided to users free of charge. However, users are responsible for communication charges incurred by using the service.
  6. This service is available 24 hours a day, 365 days a year. However, if this site determines that temporary interruption or suspension is necessary due to maintenance work, etc., the service hours may be changed. In addition, if it becomes difficult to provide the service due to force majeure, the service hours may be changed. Furthermore, this site is not responsible for any disadvantages or damages suffered by users due to the temporary interruption or suspension of this service.

Notifications to Users

Article 4

Notifications related to the operation of the website (including revisions to terms, addition, change, or abolition of services) will be made on the Operating Company’s website.

Account Number

Article 5

The website will assign an account number to users for using the service. The account number is automatically issued when users register as members or add “Hoverdrive” as a friend on LINE.

Outsourcing of Credit Card Payment Operations

Article 6

  1. This site outsources credit card payment operations to GMO Payment Gateway, Inc. (hereinafter referred to as “GMO-PG”).
  2. Users agree that GMO-PG will act as the payment agent and that this site will disclose, provide, and deposit the necessary information to GMO-PG for payment.
  3. The credit card information (cardholder name, card number, expiration date) registered by the user will be registered with GMO-PG, and this site will not retain it.

Account Validity Period

Article 7

The validity period of the account is indefinite, and there are no usage fees. However, if there is no reservation registration or use for one year from the last reservation registration date or from the membership registration date, the user’s account number or LINE user ID will be deleted.

Account Management Obligations

Article 8

  1. Users are responsible for the use and management of the account, etc., provided by this site.
  2. Users are responsible for any damages caused by insufficient management, misuse, or use by third parties of the account, etc., and this site is not responsible.
  3. If users know that their account number, etc., has been stolen or used by a third party, they must immediately notify this site and follow any instructions from this site.
  4. This site is not responsible for any damages suffered by users due to the use of their account number, etc., by third parties. In addition, any use made with the account number, etc., will be deemed to have been made by the user, and the user will be responsible for all debts, including purchase prices, arising from such use.

Prohibited Acts

Article 9

  1. Users must not engage in the following acts when using the service:
    (1)Acts that cause or may cause damage to the website or the Operating Company
    (2)Unauthorized use of account numbers
    (3)Use or provision of harmful programs such as computer viruses through or in connection with the service
    (4)Acts that cause inconvenience or disadvantage to third parties, acts contrary to public order and morals, acts that violate or may violate laws and regulations
    (5)Fraudulent purchases such as double purchasesviolate or may violate laws and regulations
    (6)Other acts that this site deems inappropriate
  2. Users must not engage in the following acts regarding the credit card registered for payment:す。
    (1)Falsifying the name on the card
    (2)Unauthorized use of another person’s card and acts that violate the terms set by the card issuer
    (3)Other acts deemed inappropriate by the card issuer or financial institution

Suspension or Cancellation of User eligibility

Article 10

  1. If users engage in any of the following acts, the website may immediately suspend or cancel their user qualification without prior notice. However, if the user has validly entered into a contract for the use of the service or purchase of goods, the user is responsible for the related debts.
    (1)If the User engages in any acts prohibited under Article 9.
    (2)If the User violates these terms.
    (3)Interference with the operation of the website
    (4)Other acts where this site deems the user inappropriate
  2. This site is not responsible for any damages incurred by users due to the measures taken in the preceding paragraph, even if the user cannot use this service.

Loss of User Eligibility

Article 11

If users wish to terminate the use of this service, they will lose their eligibility as a user under these terms by uninstalling the Hoverdrive app or unregistering the Hoverdrive app as a friend on LINE.

Payment, Ticket Issuance, Transfer, and Refund within This Site

Article 12

  1. Payment and issuance within this site are considered to be completed when the ticket is displayed on the ticket list screen within this site.
  2. Tickets issued within this site can be transferred using the prescribed method within this site. However, transferred tickets cannot be transferred to another person.
  3. Refunds for tickets issued within this site will be made using the prescribed method within this site. Refunds cannot be made after the refund deadline. In addition, refunds for transferred tickets can only be made by returning the ticket to the transferor and having the transferor make the refund.
  4. Fees related to refunds will be in accordance with the operating company’s transportation terms and conditions.

User Responsibility

Article 13

  1. Users are responsible for managing their “account number” to prevent unauthorized use. The site is not responsible for any fraud or disputes arising from the user’s management.
  2. Users are responsible for setting up an appropriate usage environment (equipment, software, etc.) to use this service.
  3. The site is not responsible for any malfunctions or effects caused by the user’s equipment.
  4. Users must comply with these Terms of Use, as well as internet etiquette, moral standards, and technical rules. If the Site suffers any damages due to the User’s violation of these terms or engagement in fraudulent or illegal activities, the Site may suspend the User’s access to the Service or seek compensation for damages
  5. If the User violates these Terms, the Purchase Contract, or any applicable laws, and causes damage to the Site, the Operator, or third parties, the User shall be responsible for compensating for such damages and agrees in advance to indemnify the Site, the Operator, and third parties.
  6. If the actions of the User, as described in Article 9, cause damage to the Site, the Operator, or third parties, the User shall bear all legal responsibility, even after losing their user eligibility.

Site Responsibility

Article 14

  1. The site will make efforts to resolve any issues or disputes arising from the service through sincere discussions between the parties but does not guarantee any responsibility.
  2. Users acknowledge that this service may not always be secure even if necessary encryption processing is performed.
  3. The site is not responsible for any damages incurred by users from using the service.
  4. The site is not responsible for any disadvantages or damages incurred by users or third parties due to delays, changes, interruptions, suspensions, access restrictions, or discontinuation of the service.
  5. The site is not responsible for any damages incurred by users due to reasons attributable to the site or the company.

Service Changes

Article 15

  1. The site may restrict access to the service at its discretion if deemed necessary.
  2. The site may suspend or interrupt the service without prior notice to users in the following cases:
    (1)Regular or emergency maintenance of the service system.
    (2)Inability to provide the service due to emergencies such as war, riots, labor disputes, earthquakes, eruptions, floods, tsunamis, fires, power outages, etc.
    (3)Other cases where the site deems it necessary to temporarily suspend or stop the service for operational or technical reasons.
  3. The site may transfer the operation of the service to a related company without prior consent from users.
  4. The site will notify users in advance of any changes, suspensions, or interruptions of the service. However, this does not apply in emergencies.

Ownership of Rights

All rights related to the programs, software, services, procedures, trademarks, and trade names that constitute this service, as well as the services provided by this service and the associated technologies, belong to this site. Users must not engage in any acts that infringe on these rights.

The administration office of this site is located within Oita Daiichi Hoverdrive Co., Ltd.

Personal information handled by this site will be in accordance with the separately established “Privacy Policy.”

Handling of Inquiries

Questions, complaints, opinions, and inquiries regarding the handling of personal information related to this service will be accepted as follows. However, inquiries related to the operation and navigation of the hovercraft and complaints to the operating company will not be accepted. Inquiries related to the operation and navigation of the hovercraft should be directed to the operating company. This site will not respond to inquiries unrelated to this service.

Changes to Terms

Article 20

  1. The company may change these terms at its discretion in the following cases:
    (1)When the change to the terms is in the interest of the user.
    (2)When the change to the terms does not contradict the purpose of the contract made by the user for the use of this site, and the necessity of the change, the reasonableness of the content after the change, and other circumstances related to the change are considered reasonable.
  2. If the company changes these terms as per the preceding paragraph, the company will notify users by posting on the website, posting in the LINE talk room, or other appropriate methods by the effective date. However, this does not apply in cases of releasing new services or functions, or in emergencies (such as when it is necessary to comply with legal requirements).
  3. If users use this site based on these terms after the effective date of the changed terms, they are deemed to have agreed to the changes to the terms.
